Difference Between Criminal Record Check and Criminal Record and Judicial Matters Check

There are 2 different types (name-based or fingerprint-based) and 3 levels of background check, including a criminal record check (Level 1) and a criminal record and judicial matters check (Level 2).

1. A Criminal record check (Level 1)

A criminal record check (Level 1) will determine if you have been charged or convicted of a crime, including findings of guilt under the Federal Youth Criminal Justice Act.

2. A Criminal record and judicial matters check (Level 2)

A Criminal Record and Judicial Matters Check (Level 2) includes a check of criminal records as well as a search for outstanding charges and entries. The following information will be provided by this level 2 check:

• Criminal convictions from CPIC and/or local databases

• Summary convictions for five years

• Outstanding entries, such as charges and warrants, judicial orders, peace bonds, probation, and prohibition orders

• Absolute and conditional discharges

• Convictions where a record suspension has been granted, if authorized under the Criminal Records Act or another act or regulation

It is easy to classify those types of checks, as the Criminal Record and Judicial Matters Check are the advance check of the Criminal Record Check, which includes all the information from the level 1 check, along with some more information to be disclosed.

Both types of checks are usually required for people seeking volunteer or employment opportunities and can be conducted at the local police station without the need for fingerprints. However, there are some types of applications that will require the Certified Criminal Record Check, which can only be conducted by the RCMP base on fingerprints. The fingerprint-based check will also be requested if a name-based check does not provide a clear indication of the identity of a person.

In conclusion, it is important that you confirm with the requesting organization the specific type of check (name-based or fingerprint-based, level 1 or level 2) that they are looking for so that you can contact the correct office to get the service.

Upon request for other level checks, you will need to go to the local police first, and only if they ask for fingerprints to confirm your identity (a name-based check cannot confirm that), you will then come to us with a letter requesting fingerprinting from the police detachment.
